§ 1 Scope of Application

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts for the delivery of goods via our online shop, including all future transactions, concluded between a consumer or business (hereinafter referred to as the "Customer") and us, based on the goods presented in our online shop.

A consumer is a natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

These GTC also apply to future business relationships with businesses, without us having to refer to them again. If the business uses conflicting or supplementary terms and conditions, their validity is hereby rejected unless we have expressly agreed to them in writing.

§ 2 Conclusion of Contract, Contract Language and Storage of the Contract Text

These GTC apply to orders placed by customers through our website shop.maison-e.com. The contract is concluded with the customer (see § 1). The presentation and description of our goods on the website do not constitute a binding offer.

By clicking the "Pay Now" button at the end of the order process, the customer submits a binding offer to purchase. The contract is only concluded when we confirm the order by email.

The languages available for the conclusion of the contract are German and English.

We store the contract text and send the customer the order data and our applicable GTC by email. The contract text can also be accessed in the customer login area.

§ 3 Delivery, Shipping Conditions and Reservation of Availability

All deliveries via the online shop are handled by a service provider to the delivery address provided by the consumer. For this purpose, the customer’s contact data may be shared with third parties.

Deliveries to businesses may also be made from the business premises of Maison Ë GmbH, Auwinkl 10E, 6352 Ellmau, to the specified delivery address.

In addition to the product prices indicated, shipping costs may apply. Detailed information can be found here. Delivery is only possible by shipping; self-collection is not available.

The risk passes to the customer as soon as the goods leave the warehouse. Delivery dates are non-binding unless expressly confirmed otherwise. The current delivery time is 3–7 days; however, during peak periods delays may occur. Shipping is currently limited to EU countries. If an item is not available, we are not obliged to fulfil the contract. In such cases, the customer will be informed without delay, and any payments made will be refunded promptly. Sales are limited to standard household quantities and may be restricted during promotional campaigns.

§ 4 Payment

All prices include statutory VAT and other price components. Unless otherwise indicated in the product description, prices are total prices. Shipping costs are not included and may apply (see § 3).

The following payment options are available in our online shop:

PayPal
You will be redirected to the PayPal website during the ordering process. To pay via PayPal, you must have or create an account. After logging in and confirming your payment, the transaction is automatically processed.

Credit Card
By placing your order, you provide your credit card details. After confirming your identity as the legitimate cardholder, we request your credit card company to initiate the transaction immediately.

Sofort (Klarna)
If you select "Sofort" as your payment method, you will be redirected to the Klarna site. There, you select your bank and log in with your online banking credentials. You may be required to confirm the transaction with a one-time PIN. Upon successful payment, we receive a confirmation and will proceed with your order.

§ 5 Retention of Title

Until all claims against the customer have been fully settled, the delivered goods remain the property of Maison Ë GmbH.

For shipping purposes, we make use of third-party service providers (see § 3), who are responsible for preparing and shipping the goods.

§ 6 Warranty and Liability

If the goods are defective and the defect is attributable to Maison Ë GmbH, we reserve the right to either remedy the defect or provide a replacement. Further details about defect handling can be found in the product descriptions and on special information pages in our online shop.

Unless otherwise stated, any further claims by the customer—regardless of legal basis—are excluded. Maison Ë GmbH is not liable for damages that are not related to the goods themselves, including lost profits or other financial losses.

§ 7 Redemption of Vouchers and Discount Codes

Value vouchers and discount codes issued by Maison Ë GmbH as part of limited-time promotions are only valid in our online shop and can only be redeemed during the specified period.

Discount codes are exclusively available to consumers. Certain products may be excluded from voucher or discount code use.

Vouchers or discount codes must be redeemed before completing the checkout process. Retroactive application is not possible. Multiple value vouchers may be redeemed in one order. The order value should at least match the voucher amount. Any remaining balance will not be paid out but may be used for future purchases. If the order value exceeds the voucher amount, the remaining amount may be paid using another payment method. Cash payout and interest on voucher balances are excluded.

In case of returns for orders paid partially or entirely with a voucher, refunds will be made according to the original payment method.

§ 8 Applicable Law and Jurisdiction

All legal relationships shall be governed by the laws of the Republic of Austria, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies to the extent that the protection provided by mandatory laws of the consumer's country of residence is not withdrawn.

If the customer is a merchant, a legal entity under public law, or a special public law fund based in Austria, the place of jurisdiction for all disputes arising from this contract is the seller's registered office. If the customer is located outside Austria and is acting in the context of a commercial or professional activity, the seller’s registered office is also the exclusive place of jurisdiction. In all aforementioned cases, however, the seller reserves the right to bring proceedings at the customer’s place of business.

§ 9 Alternative Dispute Resolution

The EU Commission provides an online dispute resolution platform at: https://ec.europa.eu/consumers/odr

This platform serves as a point of contact for the out-of-court resolution of disputes arising from online purchase or service contracts involving a consumer.

The seller is neither obliged nor willing to participate in dispute resolution procedures before a consumer arbitration board.
